Returns Policy

1. Purpose and Scope

This Returns Policy (“Policy”) governs the return of skincare products purchased from TheSkinCareFactoryShop (“the Company”). This Policy applies to all consumers within the Republic of South Africa and is to be read in conjunction with the provisions of the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECT Act”).

2. Returns of Non-Defective Products

2.1. In terms of s44(1) of the ECT Act, non-defective products can be returned within 7 days after the date of receipt of the products, given that:
2.1.1. For hygiene purposes, the products must be undamaged, unused, unopened, and in their original packaging and condition.
2.2. Refunds will only be processed once the company has received and assessed the products to determine eligibility for a refund.
2.3. The consumer will be liable to pay for the return and the cost of shipping.
2.4. Shipping costs originally paid and a 2% processing fee of the product’s cost will not be refunded.

3. Returns of Defective Products

3.1. Should a defective or damaged product be received at the time of delivery/collection, it may be returned to the company.
3.2. A “defect” is defined as any material imperfection or failure in the product that renders it less acceptable than persons generally would be reasonably entitled to expect.
3.3. The consumer will be liable for the cost of shipping, however, this will be refunded once the product has been assessed and is considered eligible for a refund.
3.4. For the avoidance of doubt, the following do not constitute defects:
3.4.1. Personal dislike of the product’s scent, texture, consistency, or effect;
3.4.2. Sensitivity or allergic reactions where the product is not inherently defective;
3.4.3. Damage occurring due to improper storage, handling, or use by the consumer;
3.4.4. Normal wear and tear.
3.5. Where a product has been defined as defective, the consumer is entitled to the following remedies:
3.5.1. A full refund of the purchase price; or
3.5.2. A replacement of the same product (subject to availability).

4. Exchange of Products

4.1. Products can only be exchanged for products of the same value, however, the consumer will be liable for all the shipping costs involved.

5. Procedure to be Followed

6. Company Discretion and Finality

The Company reserves the right to make a final determination regarding the condition, defectiveness, and eligibility of any product returned in terms of this Policy.
